Welcome to Portal Ceramics. These Terms of Service ("Terms") govern your use of the Portal Ceramics website and your purchase of products from Portal Ceramics LLC ("Portal Ceramics," "we," "us," or "our").

By accessing or using our website, placing an order, or otherwise purchasing products from us, you agree to these Terms. If you do not agree to these Terms, please do not use our website or purchase our products.

Our website is currently intended for customers in the United States.

1. About Portal Ceramics

Portal Ceramics LLC is a California limited liability company that creates and sells handmade ceramic goods, including functional ceramics, sculptural ceramics, vases, and lamps.

Portal Ceramics is an independent handmade ceramics business. Our products are made in California.

2. Eligibility

You must be at least 16 years old to purchase products through our website.

By placing an order, you represent that you are at least 16 years old and have the legal capacity to enter into a purchase agreement.

Our products are not designed or marketed as children's products or toys. Ceramic products can break and may present hazards if improperly handled.

3. Our Handmade Products

Our products are handmade, and natural variation is part of the character of handmade ceramics.

Depending on the product, you may notice variations in:

  • Shape and dimensions

  • Color

  • Glaze appearance

  • Texture

  • Surface characteristics

  • Pattern

  • Other minor handmade characteristics

Photographs and descriptions are intended to represent the products accurately, but colors may appear differently depending on your device or display.

Unless a listing states otherwise, individual pieces may have minor differences from photographs or from other pieces made in the same style.

Most of our current inventory consists of individual pieces. When products are made in small batches, this will generally be stated in the applicable product listing.

Normal characteristics and variations associated with handmade production are not considered defects.

4. Product Descriptions and Intended Use

We make reasonable efforts to accurately describe our products and their intended uses.

You are responsible for using each product in accordance with its listing, care instructions, warnings, and intended purpose.

Products should not be modified, altered, repaired, or used for purposes for which they were not designed.

We reserve the right to correct errors in product descriptions, photographs, availability, pricing, and other website content.

5. Functional Ceramics and Food Contact

Certain Portal Ceramics products, including mugs and cups, are intended for food or beverage contact.

For functional food-contact pieces, we use commercially manufactured ceramic glazes and materials selected for food-contact applications. Our current commercial glaze manufacturers include Mayco, AMACO, Spectrum, and Wizard.

Commercial underglazes used on functional pieces are applied to exterior surfaces rather than food-contact surfaces.

Our personally formulated glazes are currently used only on decorative or sculptural pieces and are not intentionally used on food-contact surfaces.

Functional pieces are inspected before being offered for sale.

We do not represent that every ceramic product is "lead-free," and customers should not infer such a representation from these Terms or from the use of commercially manufactured ceramic materials.

Unless otherwise stated in a product listing:

  • Handwashing is recommended for functional ceramic pieces.

  • Functional pieces may generally be placed on the top rack of a dishwasher.

  • Functional ceramic pieces should not be used on a stovetop or in an oven.

  • Avoid sudden or extreme temperature changes, which can cause thermal shock and damage ceramic ware.

  • Do not use a ceramic piece if it becomes cracked, chipped, structurally compromised, or otherwise unsafe.

Because ceramic products are handmade and breakable, reasonable care should always be used.

6. Vases and Sculptural Pieces

Our vases and sculptural ceramics may be decorative or functional depending on the individual product.

Unless a listing states otherwise, our vases may hold water and flowers. Some pieces are primarily intended to be displayed as standalone sculptural objects.

Customers are responsible for using products in accordance with their intended purpose and any product-specific instructions.

7. Lamps and Electrical Products

Portal Ceramics may offer handmade ceramic lamps that include electrical components and are assembled by Portal Ceramics.

Lamp listings may include product-specific information regarding:

  • Bulb type

  • Maximum bulb wattage

  • Indoor use

  • Dry-location use

  • Other applicable care or safety instructions

Customers must follow all product-specific instructions supplied with a lamp.

Unless a product listing expressly states otherwise, Portal Ceramics lamps are intended for indoor, dry-location use only.

Customers should not use lamps outdoors or in wet or damp locations, exceed the stated maximum bulb wattage, use incompatible bulbs or components, or modify, rewire, disassemble, or otherwise alter the electrical components.

Portal Ceramics is not responsible for damage or injury resulting from unauthorized modification, rewiring, improper installation, misuse, use with incompatible components, use contrary to product instructions, or use outside the intended conditions of the product.

If a lamp or electrical component appears damaged, frayed, cracked, loose, or otherwise unsafe, discontinue use and contact us.

8. Product Safety and Breakage

Ceramic products are inherently fragile and may break if dropped, struck, mishandled, subjected to excessive force, or exposed to thermal shock.

Customers are responsible for exercising reasonable care when handling and using ceramic products.

Do not use a ceramic product that has developed a crack, sharp edge, structural damage, or other condition that could make continued use unsafe.

Nothing in these Terms is intended to exclude or limit any product-safety rights or remedies that cannot legally be excluded or limited.

ORDERS, PRICING AND PAYMENT

9. Product Availability

Products offered through our website are subject to availability.

Because many Portal Ceramics pieces are handmade and individually produced, inventory may be limited.

We reserve the right to discontinue products, modify product offerings, or limit quantities at any time.

10. Placing an Order

When you place an order through our website, you are submitting an offer to purchase the selected products.

An order is generally accepted once payment has been successfully processed and we have sent an order confirmation.

An order confirmation does not prevent us from canceling an order when permitted under these Terms, including where a product is unavailable, damaged before shipment, materially mispriced, or where we reasonably suspect fraud or other unauthorized activity.

11. Pricing

Prices are displayed in U.S. dollars unless otherwise stated.

We reserve the right to change prices at any time before an order is placed.

If a product is listed at an obvious pricing error, we may cancel the affected order and provide a full refund.

12. Taxes

Applicable sales taxes are calculated and collected at checkout based on the customer's location and Portal Ceramics' applicable tax obligations.

Tax treatment may vary depending on the customer's location and applicable law.

13. Payment

Payments may be processed through third-party payment processors.

By submitting payment information, you authorize the applicable payment processor to process the transaction according to its applicable terms and policies.

Portal Ceramics does not receive or store complete payment-card information when payment is processed through a third-party payment provider.

14. Order Cancellation by Portal Ceramics

We may cancel an order when reasonably necessary, including when:

  • A product becomes unavailable or is damaged before shipment;

  • A product was listed with an obvious error;

  • We are unable to fulfill the order;

  • We reasonably suspect fraud or unauthorized activity;

  • A shipping or fulfillment issue makes the order impracticable; or

  • Cancellation is otherwise permitted or required by applicable law.

If we cancel an order before fulfillment, we will provide a refund of amounts paid as required by applicable law.

If an ordered one-of-a-kind piece becomes unavailable or is damaged before shipment, we may contact you to offer an alternative piece when one is available or provide a refund.

SHIPPING

15. Shipping Area

We currently ship to addresses within the 50 United States.

We do not currently guarantee shipment to U.S. territories, military addresses, or other locations not supported by the available shipping options at checkout.

16. Processing Time

Orders are generally processed and prepared for shipment within 3–5 business days.

Business days do not include weekends, Thanksgiving Day, or Christmas Day.

Processing time is the time required to prepare an order for shipment. It does not include the carrier's transit time after an order has shipped.

We will make reasonable efforts to meet stated processing times. If we learn that we cannot ship an order within the applicable timeframe, we will notify you and provide any cancellation, refund, or delay options required by applicable law. Federal law generally requires online sellers to have a reasonable basis for advertised shipping timeframes and to provide appropriate delay notices and refund options when promised shipment times cannot be met. 17. Shipping Rates

Shipping charges are calculated and displayed at checkout.

Available shipping methods and costs may vary depending on the order and destination.

18. Carrier Delays

Once an order has been transferred to the shipping carrier, estimated delivery dates are outside Portal Ceramics' control.

Carrier delays, weather, transportation disruptions, incorrect carrier scans, and other events affecting transit may occur.

A carrier's estimated delivery date is not a guarantee of delivery.

19. Lost or Delayed Packages

If tracking indicates that a package may have been lost or significantly delayed, please contact us.

We may investigate the shipment with the carrier and determine an appropriate resolution based on the circumstances.

20. Packages Marked "Delivered"

If tracking shows that a package was delivered but you cannot locate it, please first:

  1. Check around your delivery location;

  2. Check with household members or others who may have accepted the package;

  3. Check with neighbors where appropriate; and

  4. Contact the shipping carrier.

Please also contact Portal Ceramics so we can investigate the circumstances where appropriate.

A package being marked "delivered" does not automatically mean that Portal Ceramics will deny a claim; we will consider the circumstances on a case-by-case basis.

21. Incorrect Shipping Address

Customers are responsible for providing an accurate shipping address at checkout.

If you contact us before shipment and we are able to correct the address, we will make reasonable efforts to do so.

Once an order has shipped, we may be unable to change or redirect it.

If a package is returned to Portal Ceramics because of an incorrect address, the customer may be responsible for the additional shipping cost required to resend the package.

22. Returned or Undeliverable Packages

If a package is returned because of an incorrect address, refusal of delivery, failure to retrieve the package, or another delivery issue attributable to the customer, we will determine the appropriate resolution on a case-by-case basis.

Additional shipping charges may apply if the customer requests that the item be reshipped.

23. Shipping Damage

Our products are carefully packaged, but ceramics can be damaged during transit.

If an item arrives damaged, please contact us within 7 days of delivery.

To help us investigate a shipping-damage claim, please provide:

  • Photographs of the damaged product;

  • Photographs of the shipping box and packaging;

  • A description of the damage; and

  • Any other information we reasonably request.

Please retain the damaged product, shipping box, and packaging until we tell you that they may be discarded.

We will review shipping-damage claims individually and determine an appropriate remedy, which may include a replacement or refund.

Where Portal Ceramics is responsible for a confirmed damaged shipment, we will cover reasonable shipping costs associated with the appropriate remedy.

24. Signature Confirmation

We may require signature confirmation for high-value orders or particular shipments in the future.

If signature confirmation is required, the applicable shipping option or order communication will indicate this where reasonably practicable.

25. Shipping Restrictions

We reserve the right to decline or cancel an order if, in our reasonable judgment, a particular product cannot safely or reasonably be shipped to the requested destination.

RETURNS AND REFUNDS

26. Return Policy

Our current Return Policy is incorporated into these Terms.

Unless otherwise stated in a product listing or required by applicable law, unused and undamaged ceramics may be returned within 30 days of delivery.

Please contact us at portalceramicshop@gmail.com before sending a return so that we can coordinate the return.

Returned products should be unused, undamaged, and packaged in the original packaging supplied with the order.

The customer is responsible for return shipping costs for ordinary returns.

27. Refunds for Ordinary Returns

For an approved ordinary return:

  • We refund the purchase price of the returned ceramic;

  • Original shipping charges are not refunded;

  • The customer is responsible for return shipping; and

  • Refunds are issued to the original payment method.

Once the returned item is received, we will initiate the applicable refund within 5–10 business days.

Your payment provider may require additional time to post the refund to your account.

28. Defective Products

If a product has a genuine manufacturing defect that was not disclosed in the listing, please contact us.

Depending on the circumstances, you may choose between an appropriate refund or replacement, where reasonably available.

Normal handmade variations, including reasonable variations in glaze, color, texture, shape, or other handmade characteristics, are not automatically considered defects.

29. Exchanges

Exchanges are not guaranteed and may be offered on a case-by-case basis, depending on product availability and the circumstances.

30. Pre-Shipment Cancellations

You may request cancellation of an order before it has shipped.

If the order has not yet shipped, we will generally honor a cancellation request and provide a full refund, subject to applicable law.

Once an order has shipped, it cannot ordinarily be canceled and must instead be handled under the applicable return policy.

31. No Store Credit Requirement

Portal Ceramics does not routinely issue store credit in place of refunds.

Where a refund is required, we will provide the applicable refund in accordance with these Terms and applicable law.

32. Return and Refund Abuse

We reserve the right, to the extent permitted by law, to decline future transactions or limit return privileges where we reasonably believe a customer is abusing our return or refund policies, engaging in fraud, repeatedly making unsupported claims, or otherwise misusing our policies.

Nothing in this section limits rights that cannot legally be limited.

COMMISSIONS

33. Future Commission Work

Portal Ceramics may accept custom or commissioned work when a customer's concept aligns with our creative practice and availability.

Commission arrangements will generally be established through written communication by email before work begins.

Unless otherwise agreed in writing:

  • 50% of the agreed price is due before work begins.

  • The remaining 50% is due upon completion.

  • Once work has begun, the initial 50% payment is non-refundable.

  • Custom work is not ordinarily eligible for return simply because the customer changes their mind.

  • Any additional terms specific to a commission will be communicated before work begins.

Custom work remains subject to applicable product-safety and consumer-protection laws.

INTELLECTUAL PROPERTY

34. Our Intellectual Property

Unless otherwise stated, Portal Ceramics owns or controls the rights in the original content we create for our website and business, including:

  • Portal Ceramics branding and logos;

  • Original product photographs;

  • Product descriptions and website copy;

  • Original ceramic designs and artwork;

  • Original graphics and illustrations; and

  • Other original materials created by Portal Ceramics.

These materials may be protected by copyright, trademark, and other intellectual-property laws.

35. Restrictions on Copying Our Work

You may not, without our prior written permission:

  • Reproduce our original ceramic designs commercially;

  • Create molds or casts from our work for reproduction;

  • Scan, 3D-print, digitally reproduce, or otherwise reproduce our designs;

  • Manufacture or sell copies of our designs;

  • Reproduce our product photography;

  • Copy substantial portions of our website content; or

  • Use our branding in a manner that suggests affiliation, sponsorship, or endorsement by Portal Ceramics.

Purchasing a physical ceramic object does not transfer intellectual-property rights in the underlying design.

36. Customer-Provided Materials

If you provide artwork, photographs, text, logos, patterns, designs, or other materials for custom work, you represent that you have the rights or permissions necessary for us to use those materials for the agreed purpose.

You agree not to provide materials that knowingly infringe another person's intellectual-property rights or violate applicable law.

37. Commissioned Work and Intellectual Property

Unless otherwise agreed in writing:

  • The customer owns the physical commissioned object after purchase;

  • Portal Ceramics retains intellectual-property rights in its original designs and creative work;

  • Portal Ceramics may create future work using its own independent creative concepts; and

  • Portal Ceramics may photograph completed commissions and use those photographs for its portfolio, website, social media, and other business purposes.

This does not give Portal Ceramics permission to reproduce third-party artwork or materials supplied by a customer when the customer does not have the necessary rights.

38. Website Scraping and Automated Collection

You may not use bots, crawlers, scrapers, spiders, automated purchasing systems, data-extraction tools, or similar technologies to systematically access, copy, collect, reproduce, monitor, or exploit Portal Ceramics' website, product information, photographs, designs, pricing, or other content, except where expressly permitted by us or required by law.

This restriction does not prohibit ordinary search-engine indexing or other activities permitted by applicable law.

39. Copyright Complaints

If you believe that content appearing on our website infringes your copyright, please contact us at:

Please provide enough information for us to understand the work you believe is being infringed, the material at issue, and how you can be contacted.

We may investigate legitimate copyright complaints and take appropriate action.

WEBSITE USE

40. Permitted Website Use

You may use our website for lawful personal purposes, including browsing products and making legitimate purchases.

You agree not to use our website to:

  • Violate applicable law;

  • Commit fraud or facilitate fraudulent transactions;

  • Attempt unauthorized access to our systems;

  • Interfere with website operation;

  • Introduce malware or other harmful code;

  • Scrape or systematically copy website content;

  • Use automated purchasing systems or bots;

  • Circumvent technical restrictions;

  • Impersonate Portal Ceramics or another person;

  • Harass or threaten Portal Ceramics or others; or

  • Otherwise misuse the website.

41. Automated Purchases

The use of bots or automated purchasing systems to acquire Portal Ceramics products is prohibited.

We may cancel orders that we reasonably believe were placed using automated purchasing systems or in violation of these Terms.

42. No Customer Accounts

Portal Ceramics does not currently require or offer customer accounts for purchases.

Customers may purchase products through guest checkout.

43. Reviews and User Content

We may permit reviews, photographs, comments, testimonials, or other user-generated content on our website in the future.

If we introduce these features, additional rules may apply.

Nothing in these Terms requires Portal Ceramics to publish, retain, or display user-generated content.

If you separately provide permission for Portal Ceramics to use a photograph, testimonial, or other content for marketing purposes, that permission will be governed by the terms of the applicable permission request.

EMAIL AND MARKETING

44. Order Communications

We may send emails necessary to process and fulfill your order, including order confirmations, shipping notifications, return communications, and customer-service communications.

45. Marketing Communications

If you subscribe to Portal Ceramics marketing communications, we may send promotional emails, announcements, product releases, or similar communications.

Marketing communications will be handled in accordance with our Privacy Policy and applicable law.

You may unsubscribe from marketing communications using the applicable unsubscribe mechanism provided in those communications.

THIRD-PARTY SERVICES

46. Third-Party Services

Our website may rely on third-party services, including website hosting, payment processing, shipping services, email marketing, analytics, and other technology providers.

These services may have their own terms and privacy policies.

Portal Ceramics is not responsible for the independent policies, practices, availability, or performance of third-party services except to the extent required by applicable law.

47. Third-Party Links

Our website may contain links to third-party websites, including social-media platforms such as Instagram and Pinterest.

We do not control third-party websites and are not responsible for their content, policies, security, availability, or practices.

A link to a third-party website does not necessarily constitute an endorsement or affiliation.

WEBSITE CONTENT AND AVAILABILITY

48. Website Availability

We make reasonable efforts to keep our website available and functioning, but we do not guarantee that the website will always be:

  • Available;

  • Uninterrupted;

  • Error-free;

  • Completely secure;

  • Free from bugs or technical problems; or

  • Available at any particular time.

We may temporarily suspend, modify, or discontinue all or part of the website for maintenance, updates, business reasons, or other circumstances.

49. Changes to Products and Website

We may change, modify, discontinue, or remove:

  • Products;

  • Prices;

  • Product availability;

  • Website features;

  • Content;

  • Promotions; or

  • Other aspects of the website

at any time.

Changes will not retroactively alter an order that has already been accepted except where permitted or required by applicable law.

DISCLAIMERS AND LIMITATION OF LIABILITY

50. Product Use

You are responsible for using Portal Ceramics products appropriately and in accordance with their intended purposes, product-specific instructions, and applicable safety information.

Portal Ceramics is not responsible for damage or injury resulting from:

  • Dropping or breaking a ceramic product;

  • Improper handling;

  • Misuse;

  • Unauthorized modification;

  • Failure to follow care or safety instructions;

  • Use outside the product's intended purpose;

  • Thermal shock;

  • Unauthorized electrical modifications to lamps;

  • Use of incompatible electrical components; or

  • Other circumstances caused by the customer's actions or misuse,

except to the extent responsibility cannot legally be excluded.

51. Product Images and Handmade Variations

We make reasonable efforts to accurately photograph and describe our products.

However, actual colors may differ depending on your device or display, and handmade products may vary naturally in appearance, dimensions, texture, and finish.

These ordinary variations do not constitute defects when the product otherwise conforms to its listing.

52. Third-Party Failures

To the extent permitted by law, Portal Ceramics is not responsible for delays, interruptions, errors, or failures caused by third parties outside our reasonable control, including shipping carriers, payment processors, website-hosting providers, email providers, internet-service providers, or other third-party services.

53. Disclaimer of Warranties

To the fullest extent permitted by applicable law, Portal Ceramics makes no warranties beyond those expressly provided in these Terms or required by applicable law.

Nothing in these Terms excludes, limits, or disclaims any warranty, representation, right, or remedy that cannot legally be excluded, limited, or disclaimed.

54. Limitation of Liability

To the fullest extent permitted by law, Portal Ceramics and its owners, members, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the website or purchase or use of our products.

To the fullest extent permitted by applicable law, Portal Ceramics' total aggregate liability arising from a particular purchase or product will not exceed the amount you paid Portal Ceramics for the product giving rise to the claim.

Nothing in this section limits liability that cannot legally be limited, including liability arising from rights or remedies that cannot be waived or from conduct for which a limitation would be prohibited by applicable law.

55. Non-Waivable Rights

Nothing in these Terms is intended to waive, limit, or eliminate any right or remedy that you are entitled to under applicable law and that cannot legally be waived or limited by agreement.

INDEMNIFICATION

56. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Portal Ceramics LLC and its owners, members, employees, contractors, and service providers from claims, losses, liabilities, damages, costs, and reasonable expenses arising out of:

  • Your material violation of these Terms;

  • Your unlawful use of the website;

  • Your fraud or intentional misconduct;

  • Your unauthorized use of Portal Ceramics' intellectual property; or

  • Your misuse or unauthorized modification of our products.

This obligation does not apply to the extent a claim results from Portal Ceramics' own conduct where indemnification would be prohibited by applicable law.

EVENTS OUTSIDE OUR CONTROL

57. Force Majeure

Portal Ceramics will not be responsible for delay or failure to perform an obligation when the delay or failure results from circumstances beyond our reasonable control, including natural disasters, fire, earthquake, severe weather, government actions, labor disruptions, major carrier disruptions, power outages, internet or technology failures, or other circumstances that could not reasonably be prevented or controlled.

This section does not eliminate any refund or cancellation rights required by applicable law.

DISPUTES AND GOVERNING LAW

58. Informal Resolution

We would like the opportunity to understand and resolve the issue directly.

Before initiating a formal legal proceeding concerning a purchase or use of our website, you agree to give Portal Ceramics a reasonable opportunity to resolve the dispute informally. Unless a shorter period is required by law or circumstances require otherwise, we will have 30 days after receiving your written notice of the dispute to attempt to resolve it.

59. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent that applicable law requires otherwise.

60. Dispute Resolution

Any dispute-resolution provision in these Terms will apply only to the extent permitted by applicable law and only to disputes properly within the scope of the applicable agreement.

Nothing in these Terms is intended to waive or restrict rights or remedies that cannot legally be waived or restricted.

Nothing in these Terms prevents a consumer from pursuing an eligible claim in small claims court where permitted by applicable law.

61. Location of Proceedings

To the extent a dispute may properly be resolved in court and applicable law permits the parties to agree on venue, proceedings may be brought in Los Angeles County, California.

Nothing in this section prevents a consumer from bringing a claim in another forum where applicable law gives the consumer that right.

62. Intellectual Property Relief

Nothing in these Terms prevents Portal Ceramics from seeking appropriate legal or equitable relief to protect its intellectual-property rights, including rights relating to copyrights, trademarks, trade secrets, original designs, photographs, and website content, to the extent permitted by law.

CHANGES TO THESE TERMS

63. Updates

We may update these Terms from time to time.

When we update the Terms, we will post the revised version on our website and update the Last Updated date.

Unless otherwise required by law, changes to these Terms will apply to orders placed after the updated Terms become effective.

The version of the Terms in effect when you place an order will generally govern that transaction.

GENERAL TERMS

64. Entire Agreement

These Terms, together with any policies expressly incorporated into them, constitute the agreement between you and Portal Ceramics concerning your use of our website and purchases made through it.

Our current Return Policy is incorporated into these Terms.

Product-specific instructions, terms communicated at checkout, and written terms agreed to for a particular commission may supplement these Terms where applicable.

65. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

66. Waiver

If Portal Ceramics does not enforce a provision of these Terms on one occasion, that does not constitute a waiver of our right to enforce that provision in the future.

67. Assignment

Portal Ceramics may assign or transfer its rights and obligations under these Terms in connection with a sale, merger, reorganization, transfer of assets, or other business transaction, to the extent permitted by law.

You may not assign your rights or obligations under these Terms without our prior written consent where such consent is legally required.

68. Electronic Communications

You agree that Portal Ceramics may communicate with you electronically regarding orders, purchases, returns, customer service, and other matters relating to your transactions.

Electronic communications satisfy any legal requirement that a communication be provided in writing to the extent permitted by applicable law.

69. No Agency Relationship
